Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of the VidyaCheck mobile application and related websites (together, the “Service”), operated by Amigzo Technologies Private Limited (“VidyaCheck”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

VidyaCheck is a school management application that helps schools manage students and staff, attendance, homework, exams and report cards, fee records and receipts, timetables, circulars, complaints and school-bus transport, with role-based access for administrators, teachers, parents/guardians, students and drivers.

3. Accounts and access

• Accounts are provisioned by your school. There is no public self sign-up.
• You are responsible for keeping your login credentials confidential and for activity under your account. Tell your school or us immediately if you suspect unauthorised use.
• You must provide accurate information and keep it up to date.
• The student role is read-only: students can view their own information but cannot post public content or message other users.

4. Data roles

Your school is the Data Fiduciary / controller of the information it records in the Service. VidyaCheck acts as a Data Processor, handling that information on the school's instructions to provide the Service. How personal information is handled is described in our Privacy Policy.

5. Acceptable use

You agree not to use the Service to:

• break any law, or infringe anyone's rights;
• upload or share content that is unlawful, harmful, harassing, defamatory or obscene;
• create, upload, store or share any content that sexually exploits, abuses or endangers children (including child sexual abuse material, “CSAM”). We have zero tolerance for child sexual abuse and exploitation (“CSAE”). Such content is strictly prohibited, will be removed, accounts will be terminated, and we will report it to the appropriate authorities as required by law. See our Child Safety statement;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• upload malware, or interfere with or disrupt the Service;
• access data of students or staff you are not authorised to access, or use such data for any purpose other than legitimate school operations.

6. Your content

You retain ownership of the content you submit (for example, photos, homework, notices and complaints). You grant us a limited licence to host and process that content solely to provide the Service. You are responsible for having the necessary rights and consents for content you upload, including consent for photographs of identifiable individuals and of children.

7. Fees and payments

• Subscription fees for schools are agreed separately between the school and VidyaCheck.
• The App helps schools record the fees they collect and generate receipts; it does not currently process online payments and does not collect card or bank details.
• Refunds of school fees are governed by your school's own policy. VidyaCheck only records collection on the school's behalf.

8. Intellectual property

The Service, including its software, design and branding, is owned by VidyaCheck and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in force. You may not copy, modify, reverse-engineer, resell or create derivative works from the Service except as the law allows.

9. Availability

We work to keep the Service available and reliable, but we provide it “as is” and do not guarantee it will be uninterrupted or error-free. We may modify, suspend or discontinue features with reasonable notice where practical.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, VidyaCheck is not liable for indirect, incidental or consequential losses arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law. The Service is a tool to support school operations; schools remain responsible for their records, decisions and compliance obligations.

11. Termination

We may suspend or terminate access for breach of these Terms, including any violation of the child-safety provisions in Section 5. On termination, data is handled as described in the Privacy Policy and our agreement with your school.

12. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts at New Delhi, India have exclusive jurisdiction over any dispute.

13. Changes

We may update these Terms from time to time. The “Last updated” date shows the latest version; continued use after a change means you accept it.
